Use of this website
The content on this site is provided for general information about our services. Estimates and quotes
Estimates are free and are based on the site conditions and scope described to us at the time we quote. An estimate is not a binding contract until both parties agree to the work. Pricing may change if we encounter conditions that were not visible or disclosed beforehand — for example rock, buried debris, unmarked utilities, unexpected slope, wet ground, or a change in the scope you request. We will tell you before performing work that would change the agreed price.
Scheduling and weather
Excavation and land work depend on ground and weather conditions. Rain, frozen or saturated ground, equipment issues, and emergency storm clean-up work can move a schedule. We will keep you informed and reschedule as promptly as conditions allow. Timelines given in an estimate are good-faith projections, not guarantees.
Property owner responsibilities
- Confirm you own the property or are authorized to have the work performed.
- Identify property lines, and point out septic systems, tanks, wells, irrigation, invisible fencing, private lines, and anything you want protected.
- Obtain any permits, HOA approvals, or easements required for the work, unless we agree in writing to handle them.
- Provide clear access for trucks, trailers, and heavy equipment, and keep people, pets, and vehicles clear of the work area.
We arrange for public utilities to be located as required by Tennessee law. We are not responsible for damage to unmarked, mislocated, or private underground lines and structures, or for normal surface disturbance such as tire ruts and tracking that comes with operating heavy equipment.
Payment
Unless your written estimate states otherwise, payment is due on completion of the work. Larger projects may require a deposit or progress payments. Past-due balances may be subject to late fees and collection costs permitted by law.
Cancellations
Please give us as much notice as possible if you need to cancel or postpone. If materials have been ordered or mobilization has begun, you may be responsible for those actual costs.
Workmanship and disclaimer
We perform our work in a professional manner using appropriate equipment and industry practices, and we are fully insured. Except as expressly stated in your written estimate or agreement, we make no other warranties. We do not warrant future conditions outside our control, including settlement, regrowth of vegetation, drainage behavior during extraordinary rainfall, or the performance of pre-existing systems and structures.
Limitation of liability
To the extent permitted by law, our total liability for any claim arising from the services or this website is limited to the amount you paid us for the work at issue, and we are not liable for indirect, incidental, or consequential damages such as lost use or lost profits.
Governing law
These terms are governed by the laws of the State of Tennessee, and any dispute will be handled in the state or federal courts serving Montgomery County, Tennessee.
